Can you write off prop firm fees?
Independent contractor: If the prop firm treats you as an independent contractor and you receive payments for your trading activity (even if less than $600), you can potentially deduct your fees if they meet the criteria of ordinary and necessary business expenses.
Prop Firm Structure:
Trading with Personal Capital: If you are using your own capital to trade, even within a prop firm account, the evaluation and account fees are likely considered business expenses deductible on your individual tax return.
The IRS does not allow you to write off transaction fees, such as brokerage fees and commissions, when you buy or sell stocks. Instead, you can add the amount of those fees to the purchase price of your stock. The purchase price plus the cost to acquire your stock equals your cost basis.
Funded Traders: Trading large sums of other people's money
Funded traders (a.k.a proprietary traders) must still report their trading activity.
Merchant fees incurred by businesses are generally tax-deductible. These fees are considered to be ordinary and necessary expenses directly associated with the operation of your business.
You cannot classify as capital gains on trading at a prop firm as you are independent contractor and thus it is self employed income, meaning there is sales tax to be paid when you make declaration of your yearly tax income.
If your expenses are less than your net investment income, the entire investment interest expense is deductible. If the interest expenses are more than the net investment income, you can deduct the expenses up to the net investment income amount. The rest of the expenses are carried forward to next year.
Trader tax status also allows day traders to make an election for something called mark to market. A day trader who does not have trader tax status can only write off up to $3,000 in trading losses when they file taxes, but those with mark to market election can claim greater losses, if applicable.
Advisory and other investment fees charged on registered assets, regardless of the investments held, are not tax deductible. However, you have the option to pay the investment fees charged on a registered account from the registered account itself or from outside the account.

On average, a junior prop trader can expect to earn anywhere between $50,000 to $100,000 per year, while a senior trader can make upwards of $500,000 annually.
A prop trading firm looks to recruit talented traders and fund them with the company's capital. The funds that a trader makes, is then split between the trader and the company. The profit share is between 50 – 95%, with the trader taking the lion's share.
Proprietary trading firms often provide evaluation accounts where you prove your trading skills. Usually, you pay a one-time fee to enter this "challenge." If you lose money during this evaluation, you won't owe anything beyond the initial fee.
The IRS limits your net loss to $3,000 (for individuals and married filing jointly) or $1,500 (for married filing separately). Any unused capital losses are rolled over to future years. If you exceed the $3,000 threshold for a given year, don't worry.
Financial advice that is not tax deductible
Fees paid for initial investment advice or general financial advice are typically not tax deductible. These fees are considered to have not yet contributed to your assessable income (annual taxable income).

For tax years 2018 to 2025, "miscellaneous itemized deductions" have been eliminated.
You can only take a deduction for investment interest expenses that is lesser than or equal to your net investment income. For example, if you have $3,000 in margin interest but net investment income of only $1,000, you can only deduct the $1,000 in investment interest in the current year.
Interest is an amount you pay for the use of borrowed money. Some interest can be claimed as a deduction or as a credit. To deduct interest you paid on a debt, review each interest expense to determine how it qualifies and where to take the deduction.
